1. SITE REQUIREMENTS
The Client agrees to provide a suitable physical setup area that meets the following minimum requirements:
Surface: Dry, clear surface free of debris, hazards, or standing water.
Weather & Safety Policy (Outdoor Events): For the safety of participants and the protection of equipment, outdoor events are subject to weather conditions. If severe weather (such as high winds exceeding 15 mph or active precipitation) prevents safe operation, VAN GOLF LLC reserves the right to delay, pause, or suspend simulator operations. In the event of weather-related interruptions, any refunds, partial credits, or rescheduling options will be determined at the sole discretion of VAN GOLF LLC.
2. CANCELLATION & REFUND POLICY
Cancellations made more than 14 days prior to event: Full refund of the deposit.
Cancellations made 7–13 days prior to event: Deposit is non-refundable, but may be applied toward a rescheduled date within 6 months.
Cancellations within 7 days of event: Full service fee is due and non-refundable.
3. PARTICIPANT SAFETY RULES
The Client agrees to enforce the following safety rules with all guests and participants:
Hitting Area: Only ONE (1) active golfer is permitted inside the designated enclosure/hitting mat area at any time.
Safe Distance: All spectators and non-active participants must remain at least 8 feet behind the active golfer.
Footwear: Flat, clean athletic shoes or soft-spikes only. No metal spikes, boots, or high heels permitted on hitting mats.
Food & Drink: Strictly NO food, beverages, or glass within 5 feet of the launch monitors, PCs, enclosure, or hitting mats.
Conduct: VAN GOLF LLC staff reserves the right to deny service to any guest displaying unsafe behavior or severe intoxication.
4. EQUIPMENT DAMAGE & LIABILITY
Client Responsibility: The Client assumes full financial responsibility for any physical damage, loss, or theft of VAN GOLF LLC equipment (including launch monitors, enclosures, impact screens, computers, projectors, and golf clubs) caused by negligence, reckless behavior, or failure to enforce safety rules by the Client or their event guests.
Replacement Value: Repair or replacement fees will be assessed at full market value for damaged hardware.
5. RELEASE OF LIABILITY & INDEMNIFICATION
By signing below, the Client agrees to the following terms:
Assumption of Risk: The Client acknowledges that participating in simulated golf involves inherent risks, including but not limited to being struck by golf balls or clubs, tripping over equipment, or minor physical exertion.
Waiver & Release: The Client releases, waives, and discharges VAN GOLF LLC, its owners, operators, and employees from any and all liability, claims, or demands for personal injury, property damage, or wrongful death arising out of or related to the operation of the golf simulator during the contracted event.
Indemnification: The Client agrees to defend, indemnify, and hold harmless VAN GOLF LLC against any third-party claims, lawsuits, or expenses (including legal fees) brought by event guests or venue owners arising from the event.
6. GOVERNING LAW
This agreement is governed by and construed in accordance with the laws of the State of Michigan.
ACKNOWLEDGMENT & SIGNATURE
By signing below, the Client confirms that they have read, understood, and agreed to all terms, site requirements, safety rules, and liability releases outlined in this agreement.
